California Drops All COVID-Era Citations Against Bay Area Church and School

Calvary Chapel San Jose (CCSJ) and its affiliated Calvary Christian Academy (CCA) have been cleared by California regulators of all safety citations issued during the height of the state’s Covid-19 mandates.
Christianity Daily reports that Cal/OSHA inspectors visited both the church and school in December of 2020, following complaints that students were unmasked.
Attorneys with Advocates for Faith & Freedom say that the state agency sought and obtained a warrant from Santa Clara County Superior Court, based on a flawed affidavit.
A judge approved the warrant and 15 citations were issued to the church and school and the accompanying fines reached a total of $67,330.
Advocates for Faith & Freedom filed a motion to suppress all evidence gathered under the warrant, insisting that the warrant failed to meet the specific and articulable facts required under the Fourth Amendment.
According to Christianity Daily, the Superior Court agreed and excluded the evidence from further use.
Following the court’s decision, Cal/OSHA moved to withdraw every remaining citation against CCSJ and CCA.
Joel Oster, Vice President and Chief of Trial Litigation for Advocates for Faith & Freedom, said, “This is a complete victory, not only for Calvary Christian Academy, but for every church and Christian school in California.”
Oster added, The State tried to use OSHA as a weapon to intimidate a religious institution. They failed. And they were forced to walk away from their own claims.”
